Terms of Service

These Terms of Service govern access to and use of the Sidekick software and related websites, applications and APIs, provided by Sidekick Solutions, Inc. ("Sidekick", "we", "us"). By registering, subscribing or accessing the software, you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

1. The service

Sidekick provides business management software on a subscription basis. Features available to you are those included in the plan you subscribe to.

2. Your account

You are responsible for the accuracy of your registration details, for keeping credentials confidential, and for activity under your account. Tell us at admin@gosidekickapps.com if you believe an account has been used without permission.

3. Fees, billing and trials

Fees, billing frequency and any trial period are those shown at registration or on your order. Subscriptions renew unless cancelled. An account that is past due may be suspended until it is brought current.

4. Your data

The data you and your customers enter remains yours. We process it to provide the service and for no other purpose. You are responsible for having the right to enter the information you upload, and for the notices and consents your own customers are owed.

5. Acceptable use

You agree not to use the software to send unlawful or unsolicited messages, to store unlawful material, to attempt access to accounts or systems you are not entitled to, to reverse engineer the software, or to interfere with the service for anyone else.

6. Messaging and communications

Where the software sends email or text messages on your behalf, you are responsible for holding the consent those messages require and for honouring opt-out requests. Message and data rates may apply to recipients.

7. Third-party services

The software connects to third parties including payment gateways, telephony carriers, email providers and accounting systems. Those services are governed by their own terms, and Sidekick is not responsible for their acts or omissions.

8. Availability

We work to keep the service available but do not warrant that it will be uninterrupted, error free or secure against every threat. Maintenance, third-party outages and events beyond our reasonable control may interrupt it.

9. Termination

You may cancel in line with your plan. We may suspend or end an account for non-payment or for a breach of these terms. On termination your right to use the software stops, and you may request an export of your data within a reasonable period.

10. Limitation of liability

To the extent permitted by law, Sidekick is not liable for indirect, incidental or consequential loss, or for lost profits or data. Nothing here excludes liability that cannot lawfully be excluded.

11. Changes

These terms may be updated. The version in force is the one published here, and continued use after a change means you accept the revised terms.
